GDPR Compliance for Indian Companies

EU GDPR Compliance for Indian Processors, Exporters and SaaS Vendors

GDPR compliance for Indian companies processing EU personal data - SaaS vendors, BPO and KPO firms, healthcare and finance back offices, and exporters. Data mapping, lawful basis, DPAs and Article 28 processor obligations, transfer mechanisms, data subject rights, breach procedures and a DPIA where required. Run alongside DPDP Act readiness so one data map serves both regimes. CISA-qualified lead, CERT-In empanelled.

The Problem

An EU client sends a data processing agreement and a security questionnaire, and the Indian supplier has no record of what personal data it holds, where it sits, or on what legal basis it is processed. The contract stalls on a clause nobody can answer.

What We Do

  • Data Mapping
  • Role & Transfer Position
  • Contracts & Policies
  • Rights & Breach
  • Evidence & Review

What You Get

  • Answers EU client DPAs and security questionnaires with evidence
  • Data map and records of processing that survive a client audit
  • Article 28 processor obligations written into your own supply chain
  • Transfer mechanism and SCC position settled, not assumed
  • Data subject rights handled as a process with a clock, not ad hoc
  • One data map serves GDPR and the DPDP Act together
  • Breach procedure that can meet a 72-hour notification
  • DPIA where the processing requires it

Why weeks, not months

AI-assisted evidence review, one client portal

Every GDPR India engagement runs on the Praxis-Q compliance platform. You upload evidence per control, AI scores it against the requirement, and your auditor reviews in the same workflow — from scoping through to the issued, publicly verifiable certificate.

AI evidence scoring

Every upload is scored against the control before an auditor sees it — gaps surface in minutes, not at the review meeting.

One client portal

Scoping, evidence, auditor queries and status live in one place. No email chains, no spreadsheet trackers.

Auditor sign-off

Praxis-Q auditors review inside the same workflow, so review rounds shrink and the certificate issues sooner.

Frequently Asked Questions

Does GDPR apply to an Indian company?
Yes, in two situations. If you process personal data on behalf of an EU controller you carry processor obligations under Article 28 by contract. If you offer goods or services to people in the EU or monitor their behaviour, the Regulation applies directly under Article 3. Most Indian SaaS and BPO firms fall into the first category and inherit the obligations through the DPA.
Is there a GDPR certificate?
No. There is no official GDPR certification. What exists is evidence - a data map, records of processing, a DPA, policies, a rights process and a breach procedure - that you show a client or a supervisory authority. Anyone selling a GDPR certificate is selling a document with no legal standing.
How does GDPR relate to the DPDP Act?
They cover similar ground with different mechanics. The DPDP Act takes substantive effect on 13 May 2027 and uses consent as its primary basis, where GDPR has six lawful bases. One data map and one control set serve both, with jurisdiction-specific notices and rights handling on top. Doing them separately is the expensive route.
Do we need an EU representative?
If GDPR applies to you directly under Article 3 and you have no EU establishment, Article 27 generally requires a representative in the EU. Pure processors acting for an EU controller usually do not. It is worth settling this explicitly rather than assuming, because clients ask.
What does an EU client usually ask for?
A signed DPA with Article 28 terms, your sub-processor list, your transfer mechanism, security measures under Article 32, your breach notification commitment, and increasingly evidence of ISO 27001. The questionnaire is the same shape at almost every client; the work is having the answers ready.
