HIPAA Safeguards and BAA Readiness for Indian Business Associates

The Problem

A US healthcare client requires a Business Associate Agreement and evidence of safeguards. The Indian vendor signs the BAA without the controls behind it, and discovers the gap during the client's own audit - or after an incident.

What We Do

  • Scope & BAA Review
  • Security Rule Risk Analysis
  • Safeguards
  • Policies & Training
  • Attestation Pack

What You Get

  • Meets US covered-entity contract and audit requirements
  • Security Rule risk analysis, the obligation most often missing
  • BAA terms reviewed before signature, not after
  • Administrative, physical and technical safeguards actually implemented
  • Workforce training and sanction policy on record
  • Overlaps heavily with SOC 2 and ISO 27001 control sets
  • Breach notification procedure with defined timelines
  • Evidence pack a US client auditor can work through

Why weeks, not months

AI-assisted evidence review, one client portal

Every HIPAA India engagement runs on the Praxis-Q compliance platform. You upload evidence per control, AI scores it against the requirement, and your auditor reviews in the same workflow — from scoping through to the issued, publicly verifiable certificate.

AI evidence scoring

Every upload is scored against the control before an auditor sees it — gaps surface in minutes, not at the review meeting.

One client portal

Scoping, evidence, auditor queries and status live in one place. No email chains, no spreadsheet trackers.

Auditor sign-off

Praxis-Q auditors review inside the same workflow, so review rounds shrink and the certificate issues sooner.

Frequently Asked Questions

Does HIPAA apply to Indian companies?
Yes, through contract. An Indian firm handling protected health information for a US covered entity is a business associate, and the Business Associate Agreement binds you to the Security Rule and parts of the Privacy Rule. US clients can and do audit against it.
Is there an official HIPAA certificate?
No. HHS does not certify anyone, and no body can issue a HIPAA certificate. What US clients accept is a third-party attestation, or SOC 2 with a HIPAA mapping. Treat any offer of HIPAA certification with caution.
What is the most common gap in Indian business associates?
The Security Rule risk analysis. Firms implement encryption and access control but never document the formal risk analysis and risk management plan the rule requires, which is the first thing asked for in an enforcement action or a client audit.
How does HIPAA relate to SOC 2?
The control sets overlap substantially - access control, logging, encryption, incident response, vendor management. Firms serving US healthcare clients commonly run one control set and present SOC 2 with a HIPAA mapping, which satisfies most covered entities in a single document.
What about the proposed Security Rule update?
HHS published a notice of proposed rulemaking in January 2025 proposing substantial changes - mandatory MFA and encryption, asset inventory and network map, annual penetration testing, network segmentation, and annual written verification from business associates. It is not final and no compliance date is set, so nothing is required yet. Worth designing towards rather than retrofitting later.
